Ian Gordon – Terms and Conditions of fishing lets 

Bookings 

Once a booking for a period and/or beat has been agreed with you, it will be provisionally booked in your name and an invoice raised. 

  • A deposit of 50% is required to secure the booking. Deposits will be refundable, up too, but not after a date 12 weeks prior to the commencement of your fishing.  Payment should be sent to – Ian Gordon, 6 Elsher Road, Lhanbryde, Elgin, Morayshire, IV30 8QJ within 14 days to confirm the booking.  

  • The balance of the rent will be due no later than 10 weeks prior to the commencing date of your fishing. 

  • Should your fishing be booked less than 10 weeks prior to the commencement of your fishing, the full amount shall be paid to secure this booking. Failure to comply with the above will result in cancellation of the booking and Ian Gordon reserves the right to re-let those days without further notice.     

Cancellations  

  • Return of email, accepting the offer of fishing renders the Rod responsible for payment of the rent in full. In the event of any subsequent cancellation, Speyonline will endeavor to re-let the fishing and where successful a refund will be paid in full less a 20% administration charge. In such cases, the shortfall will be deducted, and the balance refunded. We strongly recommend you insure against cancellation. 

 Insurance 

  • Speyonline accepts no liability whatsoever for damage, injury or loss to any persons or belongings, nor shall they be responsible for any adverse weather conditions or acts of God.  

  • Speyonline requires the Rod to have third party insurance on no less than £5,000,000 sterling. It shall be the responsibility of the Rod, and not Sepyonline, to ensure each member of their party complies with this recommendation. 

  • It is the responsibility of the Rod, and not Speyonline, to ensure any children or minors in their care are properly supervised by an adult at all times.  

  • Electrical items such as mobile phones  

  • It is the responsibility of the rod to provide suitable insurance cover for the full cost of their holiday.  

Conservation  

  • Speyonline requires the Rod to comply in full with the conservation arrangements of the particular beat they are fishing. The Ghillie will answer any such questions at the beginning of your fishing day if required.  

Dogs 

Dogs will be kept under control at all times.  

Health and Safety 

  • Fishing can be dangerous and the Rod shall be required to conduct themselves with due care and attention particularly, but not limited to, situations where wading conditions may be difficult and/or dangerous because of ground conditions and /or spate conditions   

  • Rods are advised to wear life-jackets at all times particularly whilst wading and using boats. It is the responsibility of the individual to supply own life-jacket.  Failure to do so is at the risk of the individual. 

  • No boats may be used without the consent of the landlord’s ghillies.  All Rods use boats at their own risk and must satisfy themselves that the boats and their equipment are safe.  All boats should be returned to the moorings and properly locked and secured before departure.  The Rod is responsible for their conduct and safety at all times.  

  

  • All Rods must have treated their tackle and equipment against the Gyrodactylus-Salaris parasite and by accepting of those terms and conditions of let.  

General 

  • All Rods fishing do so at their own risk and Speyonline accepts no responsibility whatsoever for any claim for loss or damage arising from your agreement of the contract. 7.2 In addition, Rods will undertake for themselves  - 

  • To allow any fish caught to be inspected by anyone authorised to do so 

  • Not to damage trees or plants or obstruct the river or river banks. 

  • Not to light fires on any stretch of riverbank 

  • To report any damage to the boats, shelter or any other fishery equipment. Such incidents must be reported to Ian Gordon.  

  • Not to leave any litter in boats or surrounding area. Use litter bins if provided, remove all litter if not.  

Ghillie

  • The ghillies normal working hours are 9am – 5pm including Saturdays. The Ghillie will not be responsible for the health and safety of the Rod. 8.2 No reduction in rent shall be claimed if, for any reason, the ghillie is not in attendance. 8.3 The ghillie will have the final say in any matter relating to the fishing. Failure to comply with this may/can result in the cancellation of the remainder of the Rod’s lease. In the event of cancellation in terms of this clause, there will be no right to a refund or compensation.  

Complaints 

Any complaints by the Rod to Ian Gordon should be immediately reported verbally to or Ian Gordon and confirmed to Ian Gordon in writing within 24 hours. Failure to do so shall result in the matter being taken no further by Ian Gordon.   

 

For the purposes of this document - 

“You” – Are referred to as the “Rod”  

The “Contract” – Refers to your agreement with Speyonline
